Agreement to Terms

By accessing or using The BIG SWIM Strikes Back website, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the website or make donations.

Donations

All donations made through this website are:

• Voluntary contributions to support ocean conservation and water safety education
• Split equally between SpeSeas and Aqua-Smart Foundation unless otherwise specified
• Non-refundable once processed, except in cases of processing errors
• Subject to verification - we reserve the right to decline or refund donations that appear fraudulent

Per-Kilometer Pledges

If you make a per-kilometer pledge:

• You agree to pay the pledged amount multiplied by the total kilometers completed
• Payment will be processed after the swim event concludes
• You will receive notification before payment is processed
• The maximum distance is 100 kilometers around Tobago
• In case of event cancellation or early termination, pledges will be calculated based on actual distance completed

Sponsorship Packages

Corporate sponsorship packages include specific benefits as outlined on the donation page. We will make reasonable efforts to fulfill all promised benefits, but reserve the right to substitute equivalent benefits if necessary due to circumstances beyond our control.

Intellectual Property

The content on this website, including text, images, logos, and videos, is owned by The BIG SWIM Strikes Back, John Procope, SpeSeas, and Aqua-Smart Foundation. You may not reproduce, distribute, or create derivative works without written permission.

Live Tracking and Event Coverage

We strive to provide accurate real-time tracking during the swim event. However:

• GPS tracking may be affected by weather, equipment, or technical issues
• Live streaming is subject to internet connectivity and weather conditions
• We are not liable for interruptions or inaccuracies in tracking or streaming
• Event schedule and route may change due to weather or safety concerns

Volunteer Participation

Volunteers participate at their own risk. By volunteering, you:

• Agree to follow all safety instructions and guidelines
• Acknowledge that ocean activities involve inherent risks
• Release The BIG SWIM Strikes Back and its organizers from liability for injuries
• Consent to being photographed or filmed during the event

Limitation of Liability

To the fullest extent permitted by law, The BIG SWIM Strikes Back, John Procope, SpeSeas, and Aqua-Smart Foundation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or participation in the event.

Governing Law

These Terms of Service are governed by the laws of Trinidad and Tobago. Any disputes shall be resolved in the courts of Trinidad and Tobago.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the website after changes constitutes acceptance of the new terms.
